Agreement
These Terms of Service ("Terms") form a legally binding agreement between you and Arclet ("Arclet", "we", "our", "us"). By creating an account or using the Arclet platform, you agree to these Terms. If you do not agree, do not use the service.
If you are accepting these Terms on behalf of a company or other legal entity, you represent that you have authority to bind that entity, and "you" refers to that entity.
Definitions
"Arclet" means the interactive demo creation and sharing platform available at arclet.io and app.arclet.io, including the Chrome extension, player embed, and any associated APIs.
"Content" means any demos, recordings, screenshots, text, images, or other material you create, upload, or publish through Arclet.
"Subscription" means a paid or free plan that governs your access to Arclet features.
"User" means any individual who accesses Arclet under your account.
Account registration
You must provide accurate and complete information when creating an account. You are responsible for keeping your login credentials secure. You must not share your credentials with others outside your workspace. If you suspect unauthorised access to your account, notify us immediately at hello@arclet.io.
You must be at least 18 years old to create an account. Accounts are not transferable without our written consent.
Subscriptions and billing
Plans. Arclet offers a Free plan and paid plans (currently Growth and Business+AI). Plan features, user limits, and pricing are described on the pricing page at arclet.io/pricing. We may introduce new plans or adjust features at any time, with notice to existing subscribers.
Billing. Paid plans are billed on a monthly or annual basis, in advance. All fees are charged in Australian dollars (AUD) unless otherwise stated at checkout. Billing is processed by our payment provider; by subscribing you authorise recurring charges to your payment method.
Free trials. Where a free trial is offered, it begins on the date you activate it. At the end of the trial, your plan converts to a paid subscription unless you cancel before the trial expires.
Cancellation. You may cancel your subscription at any time through the billing settings in the app. Your access continues until the end of the current billing period; no partial-period refunds are issued unless required by law.
Refunds. We are committed to fair outcomes. If you believe you are entitled to a refund, contact hello@arclet.io and we will review your request. Refunds are issued where required by the Australian Consumer Law or where we determine a refund is fair in the circumstances.
Price changes. We may change subscription pricing. We will give you at least 30 days' notice of any price increase. Continued use of the service after the new pricing takes effect constitutes acceptance.
Access grant
Subject to your compliance with these Terms and payment of applicable fees, Arclet grants you a limited, non-exclusive, non-transferable, revocable right to access and use the platform during your Subscription for your internal business or personal purposes.
Acceptable use
You must not use Arclet to:
- Violate any applicable law or regulation
- Infringe any third-party intellectual property, privacy, or other rights
- Distribute malware, phishing content, or other malicious code
- Harvest or scrape data from the platform without our consent
- Attempt to gain unauthorised access to Arclet systems or other users' accounts
- Interfere with or disrupt the security, integrity, or performance of the platform
- Record or share demos that contain sensitive personal information about individuals without appropriate consent
- Impersonate any person or entity
We reserve the right to suspend or terminate accounts that violate this policy.
Your content
Ownership. You retain all intellectual property rights in your Content. By using Arclet you grant us a limited, worldwide, royalty-free licence to host, process, transmit, and display your Content solely to deliver the service to you and your authorised Users.
No training use. We will not use your Content to train AI models. AI-generated suggestions within Arclet (such as hotspot text) are generated using inputs you provide and are not fed back into model training using your customer data.
Responsibility. You are solely responsible for your Content and its legality. You represent that you have all rights necessary to grant the licence above and that your Content does not violate any law or third-party rights.
Removal. We may remove Content that we reasonably believe violates these Terms or applicable law, after providing you notice where practicable.
Our intellectual property
Arclet and all associated software, designs, trademarks, and documentation are the intellectual property of Arclet and are protected by Australian and international law. These Terms do not transfer ownership of any Arclet IP to you. You may not copy, modify, distribute, sell, or sublicense our platform or any part of it without our express written permission.
AI features
Arclet offers AI-assisted features, including automated hotspot text generation. These features use large language models operated by third-party AI providers. AI-generated suggestions are provided as-is and may be inaccurate or incomplete. You are responsible for reviewing and approving any AI-generated content before publishing it.
We do not use your Content or demo recordings to train the AI models we integrate with. See the AI disclosure in our Privacy Policy for more detail.
Third-party services
Arclet integrates with or links to third-party services (such as your browser, CRM tools, or analytics platforms). These integrations are provided for your convenience. Third-party services are subject to their own terms and privacy policies, and we are not responsible for their operation, availability, or practices.
Warranties
We will provide Arclet with reasonable care and skill consistent with industry standards. We warrant that the service will materially conform to its published documentation under normal use.
Disclaimer. To the maximum extent permitted by law, Arclet is provided "as is." We do not warrant that the service will be uninterrupted, error-free, or free of harmful components. We disclaim all implied warranties, including warranties of merchantability, fitness for a particular purpose, and non-infringement.
Limitation of liability
To the maximum extent permitted by applicable law:
- Our total aggregate liability to you for any claim arising from or related to these Terms or Arclet shall not exceed the greater of (a) the fees you paid to us in the 12 months preceding the claim, or (b) AUD $100.
- We shall not be liable for indirect, incidental, consequential, special, or exemplary damages, including loss of revenue, loss of data, loss of business opportunity, or business interruption, even if advised of the possibility of such damages.
Australian Consumer Law. Nothing in these Terms excludes, restricts, or modifies any right or remedy you have under the Competition and Consumer Act 2010 (Cth) and the Australian Consumer Law that cannot lawfully be excluded. Where legislation implies a guarantee that cannot be excluded and our liability can be limited, our liability is limited to: (a) in the case of goods, replacement of the goods, repair of the goods, or payment of the cost of replacement or repair; and (b) in the case of services, resupply of the services or payment of the cost of resupply.
Termination
By you. You may stop using Arclet and cancel your account at any time through account settings.
By us. We may suspend or terminate your account immediately if: (a) you breach these Terms and fail to remedy the breach within 14 days of notice; (b) you breach a provision that cannot be remedied; (c) you are insolvent or enter administration; or (d) we are required to do so by law.
On termination, your right to access Arclet ceases. We will retain your Content for 90 days after termination to allow you to export it, then delete it. Provisions that by their nature should survive termination will survive, including intellectual property rights, warranty disclaimers, and limitation of liability.
Changes to these terms
We may update these Terms from time to time. We will provide at least 14 days' notice of material changes by email or a prominent in-app notice. Continued use of Arclet after the effective date of the updated Terms constitutes acceptance.
Governing law
These Terms are governed by the laws of New South Wales, Australia, and the federal laws of Australia applicable there. You irrevocably submit to the non-exclusive jurisdiction of the courts of NSW and the Federal Court of Australia for any dispute arising from these Terms.
